Comparison between mandatory and all-risk boat insurance in Spain.

In the nautical sector, the gap between complying with Spanish law and genuinely protecting your assets is vast. Many boat owners only discover this gap after an accident. As experts in marine insurance in Spain, we break down the current regulatory framework and the coverages that make the difference between peace of mind and financial disaster.

1. Third-Party Liability (Mandatory Insurance in Spain)

In Spain, the regulations are strict. RD (Real Decreto) 607/1999 establishes the compulsory civil liability insurance for recreational vessels.

Navigating Spanish waters without this specific coverage not only leads to severe administrative fines but also means the owner is personally liable with their assets for damages to third parties.

What are the legal limits in Spain?

Contrary to what many expats believe, Spanish mandatory insurance is not unlimited. According to Article 8 of RD 607/1999, the compensation caps are relatively low compared to other European countries:

  • Personal Injury: Up to €120,202.42 per victim (max €240,404.84 per accident).

  • Material Damage: Up to €96,161.94 per accident.

The Real Risk: In an accidental collision with a luxury yacht in a Spanish marina, or if serious injuries occur, these figures are extremely insufficient. Therefore, we always recommend extending to Voluntary Civil Liability to increase these limits.

2. "All Risk" (Comprehensive) Insurance: Beyond the Law

While mandatory insurance protects others, Comprehensive Insurance (All Risk) protects your asset. In this context, we refer to the Spanish Maritime Navigation Law 14/2014.

With over 10 years of experience in the industry, our expertise shows that when buying boat insurance, you should always opt for a policy that at least covers Total Loss. It is the only way to protect your investment against the most significant financial risks at sea.

Key coverages NOT included in Spanish Mandatory Insurance:

  1. Salvage and Towing: Under Spanish Law, assistance at sea generates a right to a reward ("Premio"). Without this coverage, the salvage costs fall entirely on you.

  2. Theft: The mandatory policy does not cover theft of the vessel, outboard motors, or electronics.

  3. Weather Events: Damage from storms, lightning, or "DANA" events (common in Spain) are only covered under Own Damages policies.

  4. Total Loss and Abandonment: In the event of a shipwreck or major casualty, mandatory insurance provides zero compensation for your own vessel. Only a Comprehensive (All Risk) policy will indemnify you for the agreed or market value of the boat if it is completely lost or must be legally abandoned.

4. The Importance of "Latent Defects"

A common mistake when buying online insurance is overlooking the latent defects clause. We ensure your policy includes this protection, especially if your boat is under 10 years old, to cover construction defects that may appear later.

5. Conclusion: The Golden Rule

The premium difference between basic insurance and All Risk with a deductible is often less than the cost of a single day in a dry dock. Don't let a misunderstanding of Spanish regulations sink your investment.
